When should an asbestos inspection be carried out ?

“For all buildings individual or collective where the construction permit was given before the 1st july 1997, an asbestos inspection report must be attached to any sale legal act. The seller not using this mandatory procedure will have to indemnify the buyer in case the concerned building contains asbestos.” 
An asbestos inspection has no time scale.’’

  • Lead inspection: Lead content risk assessment (CREP)

A risk assessment report has to be from now on attached to any legal sale act for buildings made before 1st January 1949 wherever located in the French territories. It will be valid for 1 year. However, the seller will not have to update it if he can demonstrate absence of lead in the building (or below the legally tolerated level). In this case, the initial report will be attached to each move. The seller not using this mandatory procedure will have to indemnify the buyer in case the concerned building contains lead.
A lead risk assessment must be performed before the 11th august 2008 for all common all of every building made before 1st January 1949. (article L1334-8 of French public health code).

Carrez’s law :

The Carrez’s law requires that the surface of the building being sold be mentioned when it pertains to a collective property. This will have to be mentioned in any sale act or contract for collective properties:
Appartments, joint houses, offices and shops except for cellars, garages, parking spaces and small premises. The concerned surface is calculated on the floor and regards closed and covered premises with ceiling height above 1m80. Walls, steps, staircase, doors and windows opening surfaces are deducted from the floor surface (for the common parts of the collective property).
Patio and balconies are not concerned even if they have been modified in loggias. However, cupboards starting from the floor and measuring more than 1m80 can be included in the surface calculation.
If the surface figure is not mentioned in the pre sale or sale act, the buyer can ask that the act be cancelled. However this will not be possible if the surface figure is mentioned in the act even if it has not been stated in the pre act.
If the surface figure mentioned in the sale act is not correct, the buyer can ask a discount of the price pro rata to the measure error when the surface is inferior to more than 5% of the one mentioned in the act and within a period of 1 year from the act signature.
Remark : Carrez’s law protect buyers of collective properties. It does not apply to buyers of individual houses.
